I, the undersigned wish to visit Magaña Farm (“The Farm”) located at al 311 Sill Rd, Royal Oaks, CA 95076 and hereby acknowledge to Magaña Farm and to Tera Farm and all farmers operating on The Farm ( “The Operators”) that:

1. I acknowledge that I am visiting a working and functional farm and the risks in doing so are numerous and include (but are not limited to) dangers posed by operating as well as non-operating farm machinery, equipment, debris, animals, traps, unstable and uneven ground etc.

2. I am actively aware of the risks of participating in a class/activity and/or being present at and/or walking around The Farm.

3. I assume all foregoing risks of visiting the properties identified with The Farm, and accept personal responsibility for damages from my use, including, but not limited to injury, disability, or death.

4. I release, waive and discharge The Operators from any and all liability to me, my heirs, and next of kin for any and all claims, demands, losses, or damages related to my use of the farms property. I agree and accept full responsibility for any guest whom I bring to The Farm, and will defend and indemnify The Operators against any claim brought by such a person.

5. I hereby grant to Magaña Farm and Tera Farm all rights and consent to copyright, use, re-use, publish or republish, copy, exhibit, or distribute all photographs and/or video of myself to be used for their website and any educational, training or promotional electronic or printed material without restriction as to frequency or duration of usage and without compensation.

6. I accept and agree to follow the following rules

a) I will not bring any pets. 

b) Any children in the group will be supervised at all times.

c) I will not enter any of the fields or areas in the farm on my own and stay with the group.

d) I will not pick any produce except that permitted by the farmers/ tour guide on the tour. This farm is not a usual U-Pick farm, and this is a special opportunity as part of the tour. U-Pick is to be done as per rules explained and under the supervision of the farmers / tour guide.

e) I will not touch or get close to any parked or moving farm vehicles or climb on them.

f)  I will leave at the end of the tour and not re-enter and / or use the space on my own.

g) Any photographs taken are for personal use only,  I will get permission from the Tera Farm/ others before posting / sharing.

I have read the above waiver and release, understand that I give up substantial rights by signing it, and sign it voluntarily by clicking on the I accept checkbox and submitting the farm visit registration form.
